Commercial disputes don’t arise in a vacuum—they are rooted in transactional decisions, organizational dynamics, and identifiable pressure points that experienced attorneys can understand and anticipate.  This seminar is designed for commercial litigators seeking a deeper, practice-oriented understanding of how internal and external disputes originate, evolve, and ultimately resolve.

Through a series of focused sessions led by experienced practitioners, attendees will gain insight into (i) recurring transactional and organizations issues that cause deals to erupts and closely held businesses to wind down; (ii) strategic pressure points that can be leveraged in asserting and resolving claims; and (iii) advanced and creative remedies, including equitable relief and judgment enforcement strategies.

Participants will leave with a stronger ability to anticipate problems clients might face, frame disputes more effectively, and pursue practical, results-oriented resolution.

Topics and Speakers:
Origins of Transactional and Organizational Disputes 

This session will explore common terms and key provisions in transactional and corporate agreements that give rise to litigation.  Discussion of these issues and the dynamics they unleash in companies and across deal tables will help litigators better represent their clients’ interest before and after disputes arise.

Pressures Facing Closely Held Business 
This session will examine recurring pressure points between partners and stakeholders in private companies, including strategic decisions from dispute inceptions through litigation.  This session will also examine nuances in settlement agreements and uniquely tailored equitable remedies to protect members’ interests when disputes arise.

Carrying Momentum into Post-Judgment Proceedings 
This last session will provide a general overview of Illinois’s statues and Supreme Court Rules governing supplementary proceedings to enforce money judgments.  Whether a judgment is against an individual or against commercial entities poses questions and avenues for recovery.  This session will provide commercial litigators with early-dispute insights to advise clients—regardless of the merits of their case—whether litigation is worthwhile in light of an adversary’s potential assets.  And litigators will learn tools to wield before judgment that will assist with recovery after prevailing on the merits.
