TOPIC: Mother May I: Illinois’ New Rate Pre-approval Process for Health Insurers

In June 2023, Governor Pritzker signed House Bills 579 and 2296 into law, placing significant changes for health insurers on the horizon in Illinois. H.B. 579 requires Illinois to move the state marketplace from the federal platform to a purely state-based exchange by plan year 2026. H.B. 2296 establishes a new regulatory scheme for health insurers, including annual public rate filings, public notice and comment periods, granting the Illinois Department of Insurance the power to disapprove proposed rate changes, and subjecting rate disapprovals to judicial review.
