Beyond the Silver Screen: Understanding Third-Party Releases – Insights from Mass Tort Cases and the Supreme Court
The doctrine of third-party releases, wherein non-debtor parties are absolved of liability to the debtor's creditors, is one of the most heavily litigated issues in bankruptcy and often plays a particularly important role in mass tort cases. This panel will examine the issue of third-party releases, which has been made more important by Purdue Pharma, a case that has the potential to permanently change the landscape of contemporary bankruptcy practice.
