Topic: Getting Digital Evidence Ready for Family Court
Speakers: Jonathan D. Steele, Partner, Beermann
Description: A contested message is useful only for a defined evidentiary purpose. This program follows a partial screenshot through preservation, discovery, foundation and objections to a proposed hearing exhibit. The central dispute concerns authorship, context and timing. A recording and location record supply short variations. Illinois law governs the examples.
Attendees will learn to state the fact an exhibit is offered to establish and distinguish it from a broader inference, draft source-specific preservation and discovery language, including context and time information; select a foundation route and separately analyze hearsay, completeness and originals or duplicates; and prepare an exhibit plan.
