Below is a list of available on demand committee meetings.  You can search for a meeting by category or by keyword (click on "Advance Search This List.")  After you register, you can access the webcast by going to "My Dashboard."  You must be logged with your CBA username and password to see your dashboard.

    TOPIC: Climate Tort: State or Federal Court

    In 2007, the United States Supreme Court held that the EPA has authority under the Clean Air Act to address greenhouse gas emissions and their effect on global climate change. That case arose on a petition for agency rulemaking, but such administrative-law actions are only one way in which those concerned about climate change have sought to use litigation to advance their interests. State and local governments across the country have also sued major oil and gas companies and trade associations using a variety of tort and consumer protection theories, typically in state court. The presentation considers the fate of those lawsuits, their removal by defendants to federal court, their remand back to state court, and appellate review of that remand - already including one Supreme Court intervention in 2021 to clarify the scope of such review, and a new cert petition pending this fall that may (or may not) finally bring high court review to the ultimate question: Can a state-law claim lie in the field of global climate change? The presentation will provide factual and legal background on these cases, and will serve as a review of major issues in federal jurisdiction and removal from state to federal court.
