    About the Book:
    Why do Americans seem to sue at the slightest provocation? The answer may surprise you: we don’t! For every “Whiplash Charlie” who sees a car accident as a chance to make millions, for every McDonald’s customer to pursue a claim over a too-hot cup of coffee, many more Americans suffer injuries but make no claims against those responsible or their insurance companies. The question is not why Americans sue but why we don’t sue more often, and the answer can be found in how we think about injury and personal responsibility.
               
    With this book, David M. Engel demolishes the myth that America is a litigious society. The sobering reality is that the vast majority of injury victims—more than nine out of ten—rely on their own resources, family and friends, and government programs to cover their losses. When real people experience serious injuries, they don’t respond as rational actors. Trauma and pain disrupt their thoughts, and potential claims are discouraged by negative stereotypes that pervade American television and popular culture. (Think Saul Goodman in Breaking Bad, who keeps a box of neck braces in his office to help clients exaggerate their injuries.) Cultural norms make preventable injuries appear inevitable—or the victim’s fault. We’re taught to accept setbacks stoically and not blame someone else. But this tendency to “lump it” doesn’t just hurt the victims; it hurts us all. As politicians continue to push reforms that miss the real problem, we risk losing these claims as a way to quickly identify unsafe products and practices. Because injuries disproportionately fall on people with fewer resources, the existing framework creates a social underclass whose needs must be met by government programs all citizens shoulder while shielding those who cause the harm.

    It’s time for America to have a more responsible, blame-free discussion about injuries and the law. With The Myth of the Litigious Society, Engel takes readers clearly and powerfully through what we really know about injury victims and concludes with recommendations for how we might improve the situation.

    Mollie Sitkowski handles import and export control and compliance work on behalf of clients. She has assisted numerous clients in developing and implementing import and export compliance programs and offers continued training to the business areas that touch on import and export compliance. 
    She assists with export compliance matters, including advising on export screening and classification, and filing license classification requests and voluntary disclosures with the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) and the U.S. Department of State’s Directorate of Defense Trade Controls (DDTC). She has advised U.S.-headquartered multinationals, as well as foreign-based multinationals, on compliance with U.S. sanctions laws and the extraterritorial reach of U.S. export controls. 
    She also handles import compliance matters, including issues related to import valuation, tariff classification, free trade agreements, country of origin determination and marking and other import compliance areas. She has particular experience counseling and assisting clients with developing and implementing reconciliation programs, including identifying the required additions to values. In addition, she has advocated for her client’s preferred tariff classification in litigation in the Court of International Trade and the Court of Appeals for the Federal Circuit.

    BIO: Anna Rappaport, FSA, MAAA is a phased retiree, author, speaker and an internationally recognized expert on the impact of change on retirement systems and workforce issues. She is passionate about improving the retirement system, women’s retirement issues and improving job options for older workers.  She served as President (1997–98) of the Society of Actuaries and currently chairs its Committee on Post-retirement Needs and Risks. She was heavily involved in the SOA’s COVID-19 research reports. She has won numerous awards including in 2017 the Lifetime Achievement Award from the Plan Sponsor Council of America and the 2018 Lilywhite Award from the Employee Benefit Research Institute (EBRI). She is on the Board of the Women’s Institute for a Secure Retirement.

    SPEAKER/ORGANIZATION:  Erin E. Andrews, Psy.D., ABPP

    Andrews is a board-certified rehabilitation psychologist with her doctorate from Wright State University and Bachelor of Science from Michigan State University. She is past co-chair of the APA Committee on Disability Issues in Psychology and chair of the Division 22 Disability Identity Committee from its inception until 2018. Andrews is the psychology program manager for the Nationally Designated VA VISN 17 TeleMental Health Clinical Resource Hub, where she coordinates the provision of psychosocial mental health and substance use treatments to veterans throughout underserved areas across Texas via televideo technology.

    She is a co-founder of the Disabled Parenting Project, a resource for support and information for parents and prospective parents with a wide range of disabilities. This work is part of Parents Empowering Parents: National Research Center for Parents With Disabilities and Their Families, a five-year, $2.5 million National Institute on Disability, Independent Living and Rehabilitation Research grant for which Andrews serves as a consultant. Her advocacy work in this area includes representing the American Psychological Association during a 2013 congressional briefing regarding parents with disabilities and participating in a White House forum on the civil rights of parents with disabilities in May 2016.

    Andrews has published numerous peer-reviewed journal articles and book chapters and presented more than 50 professional lectures on disability topics related to her areas of research interest in disability culture, identity and inclusion. She has is the author of “Disability as Diversity: Developing Cultural Competence” (Oxford University Press), the first book to comprehensively address disability as diversity and as a distinct cultural experience. Her work on disability language has been recognized as reducing bias and eliminating euphemisms in the latest revision of the Publication Manual of the American Psychological Association.

    About the Book:
    Presidents have long invoked electoral mandates to justify the use of executive power. In Delivering the People’s Message, Julia R. Azari draws on an original dataset of more than 1,500 presidential communications, as well as primary documents from six presidential libraries, to systematically examine choices made by presidents ranging from Herbert Hoover in 1928 to Barack Obama during his 2008 election. Azari argues that Ronald Reagan’s election in 1980 marked a shift from the modern presidency formed by Franklin Delano Roosevelt to what she identifies as a more partisan era for the presidency. This partisan model is a form of governance in which the president appears to require a popular mandate in order to manage unruly and deeply contrary elements within his own party and succeed in the face of staunch resistance from the opposition party.

    Azari finds that when the presidency enjoys high public esteem and party polarization is low, mandate rhetoric is less frequent and employs broad themes. By contrast, presidents turn to mandate rhetoric when the office loses legitimacy, as in the wake of Watergate and Vietnam and during periods of intense polarization. In the twenty-first century, these two factors have converged. As a result, presidents rely on mandate rhetoric to defend their choices to supporters and critics alike, simultaneously creating unrealistic expectations about the electoral promises they will be able to fulfill.
